What is the timing on the magical '10 yr' mark as far as eligibility for reitirement & social security is concerned? Is it from the time you filed meaning you can file 6ish weeks before the 10 yr. anniversary I still be eligible or do you have to wait to file after 10 yrs.? I'm in a real pickle concerning this issue w/ a lot @ stake.

You have to be married 10 years. And it's not automatic on retirement. My ex-husband was married 27 years and his wife didn't get any of his retirement. Some kind of loop hole at UPS. She tried for 2 years with no luck. She ended up getting remarried after 18 months anyway.

Do you have to wait until the 10 yr. mark to file, or can you file let's say, 6 weeks before hand w/ the 10 yr. anniversary taking place during the waiting time? I've been told I'll be eligible for 1/2 of his retirement in this state.

I am sure the divorce has to be final. So many people stay separted for years for this reason. Have you researched your state on the retirement? I'm sure the attorney general's site or state info site could tell you.

For retirement plans, the filing of the complaint is the magic date. WAIT. You'll be glad you did.

For Social Security, it's measured from the marriage date until the date the judge signs the divorce decree.
