McClenden in Juvenile? Statute of limitations.

1. Final Judgment is entered in JUVENILE court granting Grandmom full custody of child.  Natural Mother later files for modification of custody in JUVENILE court. Must Mom meet McClendon standard or is is best interests?

2. Divorce judge enters order requiring Dad to pay 1/2  of non-covered medical bills of 16 year old child.  Dad never pays. Child is now 23.  Does statute of limitations bar Mom from taking Dad to court to pay his half?

No easy answer. Get your attorney to review with you S.P. v. E.T., Case No. 2040044 (Ala. Civ. App. December 30, 2005). The short answer is nobody really knows right now.

I honestly don't know. My best guess would that it would be difficult for Mom to recover these after letting them sit for so long, but I may be wrong.
