Your court must be different from mine. Where I practice, this would be a motion pendente lite, also called a motion for temporary relief. And it's not unusual for the party who left initially to move for temporary custody of the marital home or apartment. The party who left isn't at a particular disadvantage after a month or two. However, the longer that party stays away, the more that temporary arrangement looks like the status quo, and the more difficult it is for a judge to order fruit basket turnover.
