Okay thanks in advance for any help. My husband and I were married in Sept 2003 in NC. We split in Dec 2003 {yes same year} when he abused MY {not his} daughter. He was tried and convicted in Jan 2004. I have not seen him since Dec 2003 and we were technically seperated Dec 2004 { as per the standard living seperate and apart for one year and a day in NC, which is the law there} I moved to AL this Sept 2006 and really need to file for my divorce. It will be uncontested, absolute {no property or child custody issues, we had neither together} My question is, where do I file? I havent lived in AL 6 months yet, and from what I understand that's a requirement of at least one of the parties involved. Do I have to file back in NC? I cannot afford a trip back there just to visit the Clerk of Court. HELP! Thanks!

You may actually have to wait until you're legally a resident of AL - I'm not sure what the time period is when you are no longer considered an NC resident. It might be worth simply hanging tight for a few more months.

I'm with m_t. If you don't know where hubby is and don't want to file in NC, you'll need to wait until you've lived in AL for at least 6 months. Sorry.
