My fiance's ex wife is psycho. When they got a divorce she wasnt working. She married a man last year and still does not work. Her new husband has threatened to her that if she doesnt go to school and get a job that she will be kicked out and will have to move in to her mothers house. Recently she has gone on a rampage saying that she wants to go back to court to get soul custody. This is based on my confronting her about talking about me to the kids. She calls me names and makes fun of me. She also tells the kids that their father doesnt love them and never has and that she wants to take a baseball bat and kill us both. She belives that she deserves money to buy her kids clothes and toys. In their divorce decree she signed that she knew she was not getting child support. My fiance was obligated to pay half of child expenses and med bill as well as provide health insurance. They agreed to have joint custody. He also was to pay for her car and provide insurance. The children spend equal time at both houses though she tries to get us to take them when it's not convenient to have the kids. Of course we tell her that our lives dont revolve around her life decisions and she has to plan around her life. Neither one can prove to the court that the other is unfit. Their has been no change in circumstances or situtaions except that she moved about 30 miles away. I want to know does she have a leg to stand on and get soul custody and child support? Can proving that she smokes around them while in the car, which is damaging their health, as well as not making them put their seatbelt on which is against the law be helpful in keeping her from getting soul custody. Also her living situation isnt stable since she has been told that she might be kicked out.
