I'm so sorry for all the questions but this divorce is bigger and scarier than I've ever expected. My husband filed about 6 weeks ago but stopped it for we decided to try to work things out. Didn't work. Can he place a call, start the proceedings again and continue at this point without having to return to Al.? He's so very busy this week at work so he might not even have the presence of mind to start the proceedings yet. Will I have my filing fee returned to me when I file today if the court sees he has already continued with the proceedings?

You will not have your filing fee returned in any case. It's possible, however, that your complaint would be dismissed if it duplicates a case that hasn't already been dismissed.
