I just got divorced in February, but my child support can be reviewed as early as next February.  My deadline for submitting documentation is October.  At the time of the divorce my income was greater than my ex's.  I just got a significant raise, and he will probably get a raise in September.  (We both work for school districts and I know when his contract renews.)

I don't want to incur legal fees just to have a judge reject my claim.  So, how do I figure out whether to pursue this?

Best thing to do is study your state's guidelines for modification and see if the likely increases are worth it.

I would say that if you're not sure, that's a good reason not to file. When it's time to file, I don't think there will be any doubt left.
