the one retirement account that i get all of, appears to have close to 30,000 missing... they are refusing to give me the history of the account b/c it's in the X's name...
they also say that i have to have the account numbers to get the funds...
i have the 10 funds that the money was in, but apparently the X moved the funds to different accounts and i have no access to these...
anyway to resolve ?
can i get this w/o going back to court?

I would start with a letter to Ex by certified mail. Limit your statements to what you know from your own observation. For example, you know that at one time the account contained X and now it contains Y. You don't know that your Ex siphoned money off.

If the Ex doesn't respond (within the time period you set) with an explanation of behavior that satisfies you, then it's probably time to talk to your lawyer about returning to court.

just got off the phone w/the company involved... the original guy was very helpful... got me the 2004 to 2005 history... somewhere in the first year almost 1/2 of the value of the account disappeared...
the value that the property settlement stated was the original amount + about 10% growth on the account for that year.
they are now saying that they refuse to give me anymore information as the account was in the EX's name during this period.
will get the attorney to send the letter...

I'm so green when it comes to divorce, and so afraid. Is it a given that all banking transactions will  be submitted and is he able to move money around prior to the big D so I won't get any of it? I possibly have a small window to get my hands on a little before the papers are served. Dose he have to give me money during this time period? The phone and utilities are in my name.

Shadow, you have so many questions that it sounds to me as if you need to do some reading on the web and on the Internet before you negotiate with your husband. The easy thing to tell you would be to go see a lawyer, but I'm afraid you wouldn't get your money's worth yet, because you don't even know yet what questions to ask.

Take some time and read Divorceinfo.com and other web sites, and go to your local public library and read books about divorce. You'll be able to get through this, but you will need to do some homework first.
