My spouse went back to his native country without notifying me that he was leaving. Can I file for divorce without his signature?

You do not need his signature to file for divorce so long as you are a legal resident of the county in which you file.

At some point you will have to demonstrate that you attempted to have him served with regard to said filing.  If he does not respond, then it is likely the court will award the divorce based on abandonment.

AS TC said - of course you can file w/o his signature. But you will have to have shown a good faith effort in serving him before being permitted to serve by publication (i.e. putting an ad in the paper). And then be aware it would have to be a set of papers in an area where he has a shot at seeing it.

I don't think I will be able to serve him in his country. The country is war torn. What are my options in this situation?

file for divorce in the town you live in as soon as possible - under grounds of abandonement.

I really want this taken care of ASAP, but just feel that it want be so easy with the court. I had planned on doing my own paperwork but may need to seek legal help with this matter. Any suggestions?
