I'm opposed to spanking at school and I have not consented to it (written to the school expressing this). My ex is not & has consented to it, same manner. What is the law? Does the school have the right to spank even though I have not consented to it, just because he has? We have joint custody, so it is considered 50/50

I'm not an attorney and I can't tell you what the courts in Bama would say.
I can however, tell you what happened in my own situation. Ex and kids lived in Iowa. Per Decree I shared 50/50 Joint legal custody. Issue came up on holding son back in 1st grade. I supported, ex did not. School chose to go with ex as she had primary physical custody.

Like TC, I would assume the parent with primary custody would have the say so.
But...
at least one site that I've found (albeit old) says that AL doesn't have to have parent consent to paddle.

The county where my children are includes a form with their school's registration packet at the beginning of the year asking if you consent or not. I remember it being in one of my children's packets, but not the other, so I didn't think about it. This issue only came up when my child told me she was spanked. My main issue is that I was never notified by the teacher, before or after the incident. But, i have just gotten a reply from the teacher that "corporal punishment will no longer be used" in respect to my wishes! Instead, they will write a "behavior plan" to be followed rather than the regular course of punishment--there are other issues that have to be taken into consideration in my case. I think the law is that if one parent opposes it, they can't do it, until they have a court order...kind of like any kind of medical care releases, information releases, etc.

Lately I've heard that now parents divorcing in Alabama can be made prime over five different areas of responsibility for their children such as education, religion, activities, health or medical and one other. For example, dad might have prime on education and religion and mom might have prime on activities and medical. So, I would think that the parent that was prime in education, for example dad, would have the say so for whether corporal punishment could be used at school. I don't know.
Anyone else have any experience with this?

My divorce specifies who has final decisions regarding:
academic
civic
cultural
religious
athletic
medical and dental
It was filed in 1999 in Shelby Co.
