is it still considered adultry if you havent lived in the same house over a yr and going through a divorce and have a boyfriend

From a striclty by the book legal perspective, in most states, until the divorce is final and the decree is signed by Judge and entered into the record by the Clerk of Court...yes, any intimate activity is considered adultry in most states.

I all reality...it probably doesn't amount to a hill of beans unless there are children involved and this is a very hotly contested divorce...even then...probably not much other than fuel for a smear campaign.

That having been said, I always encourage people to keep their pants zipped up while they're married, not only for legal reasons but also because it's too soon for you to be coupling up with somebody new. Better to take 2-3 years and rediscover who you are separate from men.
