Maybe I am not explaing this correctly. Child support was calculated based on the fact that she signed a court affidavit stating that she was paying for health insurance. Child support was increased BASED on this price. His attorney is asking that support be lowered because she voluntarily dropped coverage that she "swore" in an affidavit that she was paying for. The form actually states that it was "perjury" to falsify this information. His attorney is providing proof that she applied to cancel this insurance 3 days after the court date, knowing that her support had been increased. She asked for an increase in support KNOWING that she was going to cancel the insurance. She just wanted more money.

Surely anyone with common sense can see this is fraud.

I can see your point. I believe that you are correct. It seems your husband's attorney also sees this is correct and is trying to rectify the problem.

I really hope your husband is successful.

I know that everyone here wants what is fair and right, and I'm sorry if I haven't explained this correctly, but maybe the last post did. I just didn't go into the details. It's been a mess, just like the tax forms. Who in their right mind signs forms in court in front of their OWN attorney then flagrantly disregards? i just don't get it.

Well, good news. Daughter has called and wants to spend her 14th birthday with us, bringing two friends of course. We have hosted her last four birthday "bashes," so I guess it's a tradition now. I thought she might now this year because of the age, but she'll be here next week, and we saw her last weekend. I'm glad she's not torn in the middle of this anyway. That's a lot to be thankful for. Mom has tried, but apparently without much success. Kids are smarter than we give them credit for sometimes.

Thanks for all the input, and sorry if I have sounded "snippy." I just hate my husband being taken advantage of.

Husband's ex had to appear in court yesterday to explain why she hasn't produced Discovery responses. They were delivered  to my husband's attorney the night before at 4:45. She requested an extension of time for the trial, which is the 18th of this month, but the judge declined the request. One small miracle, a couple to go. Grin

good news. don't ya love it? they can "reply" 15 minutes before COB the day before the court appearance and then act like everything is fine.
