Hello, My husband and I are divorced, we split the profit on our house, I got a chunk up front and he asked if he could pay me the balance over time, which is in our divorce decree. here is the dilemma. He still owes me $13,000 and he is filing bankruptcy, and is including me as a debt. He said he would continue to pay me, that I should TRUST him, Yeah right.  I left and took nothing, I had to start over, he wanted to keep the house I wanted to sell it and be done with it.   What are my rights? Should I contest it? He said if I do that  I stand to get NOTHING!!!  Should I put a lean on some of his property? I feel if I put a lean on the house he would just walk away from it.   ANY advice anyone can give would be GREATLY appreciated.  Thanks and Merry Christmas!!

I know that some things are not bankruptable, like child support and student loans that are federally funded.  You should see a bankruptcy attorney and the attorney who handled your divorce.

Thank you Livealittle for your advice.  I was not sure wether to see a divorce attorney, We did our divorce ourselves. Or a bankruptcy attorney.  Happy New Year!

There are plenty of good lawyers out there who do enough bankruptcy and enough divorce to be competent in both spheres. Make sure yours has that dual expertise.
