this is a sticky situation! My son was born with Cerebral Palsy. The divorce decree states that when I fail to get him for visitation the ex- can hire a care taker to care for him and that I will be responsible for the bill. I am in the process of moving out of state because of a new job. Upon his birth he was a rewarded a trust fund. I have asked my ex to contact the trust company to be reimbursed for the funds but she refuses. What can be done about this?

I'm confused.  Why are you trying to get your ex to tap his trust fund?

I fully understand that it isn't my son's bill, but yet the  ex uses the trust fund to pay his grandmother to watch him; also the last time we were in court she paid her attorney fees with the trust fund, pays to have the grass cut from the trust etc. Undecided

You will not win if you take it to court imo....I can't imagine any court agreeing with your approach.  Just because she does is doesn't make it right.  In fact, I would seriously consider consulting a family law attorney with regard to your ex using the Trust money for frivilous expenditures....that isn't right either.

I agree that you're unlikely to win this one. Also that you should see what can be done about her tapping into the fund.
