I don't know how much money that you have but you need to get a good attorney because it can cost you way more than you think in the long run if you hire someone that allows your STBX to have a more favorable settlement from a judge than you get.

If your STBX has not acquired an attorney yet, then you need to call every good attorney in Huntsiville and set up an appointment to meet with them about representing you.  This will block your STBX from being able to hire the best to represent him while you find the best attorney for you.

Listen, you can NOT judge the cost of an attorney by how much they charge an hour to represent you.  I've had 200 dollar per hour attorneys to cost me less than 125 dollar per hour attorneys because the more expensive attorneys that know what they are doing can knock your case out in a lot less hours than a less expensive attorney.  If a cheaper attorney has little to no experience with an issue in your case, you are going to have to pay for all the hours it takes them to come up to speed on it.  It can be a lot cheaper to just go to a high dollar per hour attorney and get the matter taken care of than to waste your time with someone that doesn't know what they are doing.

Also, I don't know how you are judging that you have no money.  In a marriage all assets that you've acquired since you were married such as bank accounts, real property, automobiles, boats, and so on belong to both of you.  When the divorce decree is finally settled, you may receive some money that your STBX is trying to hoard in some personal bank account somewhere.  You can be awarded attorney's fees if your situation warrants it.  If this is the case for you, then if you don't have the cash for the attorney's retainer, then borrow it with the knowledge that you may get it back when the divorce is finally settled.  Loans that you initiate while you are married have to be settled in your final divorce decree and are the responsibility of both of you until the divorce is final.

My recommended divorce attorneys in Huntsville:

Dinah Rhodes  (Used to be in practice with Billy Bell, now Judge Bell)
Susan Conlon (Best friends with Dinah Rhodes, she comes form somewhere in the northeast US originally)
Bill Burgess (A little more expensive than most, has been doing family law for a long time)
Christina Dixon (I understand she is great for handling divorces involving domestic abuse)
Leigh Daniel (She's been practicing family law for nearly 15 years)
Bill Hall (Good for cross examination, I have not met him, does not work exclusively family law I'm told)

Just about all of these names have a staff of people working for them and other attorneys in practice with them.  I believe you will be in good hands with any attorney on their staff but it is your choice whether you go with someone on their staff or stick with them.  I would stay with the names I've listed here.  I believe the retainer for Dinah Rhodes on a contested divorce is 3000 dollars.  I believe it is 5000 for Bill Burgess.  You will be refunded any retainer not used.  But, don't count on getting any back most of the time.  I believe most if not all of these attorneys are 200 dollars per hour or more.

In my opinion, a good attorney is worth every penny they charge.

Hope this helps.

And if you do not already have an attorney, spend a few dollars and get several paid for consultations.

I was in your spot in 2005 - abusive stbx who wouldn't support his 2 small kids - ages 4 and 6 - working to keep a roof over our heads and food on the table. Do a lot of your own research, list everything you want, and go to your attorney prepared. I did that and Christina Dixon charged me very little over the filing fees because I had basically done all her work for her. My x took me back to court in 2007 and that cost about $2500, but was worth every penny.

I would be happy to meet with you and help you if you want. just send me a pm and we'll get in touch.

Thank you for the help. I did hire Leigh.  She has been great.  He has hired Suzette Daniel???  Don't know about her but of course he said she is the best.  He is threatening to go for full custody.  Said he has a lot on me, but really all he has is that I am a diabetic and have gone into diabetic coma twice in 6 yrs.  He is crazy!  I moved out because of abuse.  He says I will have to pay half of the mortgage payment and wants  child support figured on what it will cost in August when our youngest go's to kindergarden and  only has after school care.  He is not paying anything right now. It's Christmas and times are hard.
