Ex filed chapter 13 on child support arrears, Hasn't paid into chapter 13 in 2 months.  Hasn't kept up with current child support payments either.  In the state of Alabama without going through DHR how can I file "A motion of relief from automatic stay"?  DHR has a major back log and I don't have time to wait on this anymore.  He filed on almost $8000 and is again over $1200 behind.  I have been exteremly paitent with him and because he is in Chapter 13 I don't dare ask if and when I'll recieve payments.  And all the attorney's I have spoken to are for the debetor NOT the creditor.  Also what is the time period of non payment before he gets thrown out of chapter 13?
