I'm not sure how to ask this question properly...so let me explain the long way.

Husband & Ex-wife have been "negotiating" several changes to their decree including child support, health insurance and visitation. My husband first saw a lawyer in March 08 and presented the ex with the proposed changes in May 08. While they have both agreed that child support should be modified and the health insurance should be changed, they can not come to an agreement about visitation. They started out trying to negotiate with each other and then through lawyers-each of them has changed lawyers since this started. It has finally come down to going to court.

So, my question is...will child support be modified and retroactive to when the papers are filed with the court or can they be modified to when this began? We really think she is dragging this out on purpose. His child support is more than it should be AND he is paying the insurance premiums for the child. (In the new provisions she will maintain health insurance and there is no premium). And he does not get the extra visitation. this really sucks.

Typically, if there's an increase in child support, the court will raise child support retroactive to the filing date of the petition, but if there's a decrease the court usually doesn't make the CP pay it back. I'm sorry.
