Thanks for your reply to my first post concerning my IRS issue. I do not think the IRS withheld the return because this was pending in both 2003 and 2004 when she filed also. The IRS explained to my husband that all she had to do was file a form each year with a copy of the decree until he had paid the debt off. She just took it upon herself to pay it and now was her money back from him. I guess my question is can he be forced to pay her back now when he was taking care of this debt himself through payments to the IRS? Of course she mention court but I can't help but wonder how the judge will look at her for doing this when he issued the order for him to be responsible for this debt. It didn't mention her paying half and then him reimbursing her. Thanks for your thoughts.
