I have a child in private school (she attends with me, as I work there) and a 1 yr old.  I do not make enough money to put my son in daycare. I tried it, but at over $100 a week I could not even make it two months. My Dad keeps him now, and I also use a two day a week church nursery at about $100 a month. I would like to be able to put my son in daycare, once his Dad is ordered to pay child support and possibly alimony. I know that daycare costs are included in AL child support calculations. So I have two questions.

1. Being as I can't afford daycare, will the judge factor in an allowable amount so I may be able to enroll my son in daycare. Without his Dad's help it is just not possible. I have the reciepts and price list of the facility I used and it is a standard tuition.

2. My daughter's tuition is taken out of my pay, up front, as I work at the school. Will any of that money be considered in the child care costs?

Not sure about your state, but it has been my experience that normally the NCP is held responsible for 1/2 of legitimate childcare costs.

If your paystuvs reflect the fact that the school is taking money from your check to pay for childcare I am fairly certain those deductions will be included in any calculations....if the school is doing this under the table.....unless they are willing to document such activities, I doubt the court will take your word for it.

I'm not sure what you're asking. If you're asking whether Dad's going to be required to pay his share of work-related child care, the answer's easy. Yes, but at the limited rates set by DHR. You can see the current rates here: http://www.divorceinfo.com/alchildcarerates.htm.

If you're asking whether the judge will get creative and do something else to help you, probably not.

The judge won't treat private school tuition for a school-aged child as child care cost.
