I recently went to court to modify an existing child support order.  We have 50/50 joint custody.  Our 3 children were in elementary school when we separated and our oldest is now a senior in high school.  My ex agreed to pay all costs for High School (his income is 3 times what mine is - $150,000) so that they could attend better schools.  The commissioner decided that the High School tuition should be included in the child support formula ($23,000 per year) which means I will not get any support now.  My ex testified that I have never paid, nor has he asked me to pay for the tuition.  Should I reargue, or do a Review of Commissioner's Order?  Or am I out of luck?  I did pay 50% of Parochial School tuition when they were in Elementary school.  With all other costs split, I will have a difficult time making ends meet.  I have 10 days to decide and put in a motion.  I am representing myself.

Are you trying to say it costs 23K per year to send your son to H.S.....or am I just missing something here?

It is $23,000 to send all 3 to High School

I'd be surprised if anybody here will know even as much as you do about your prospects on rehearing. This seems like a good time to spend $2-300 on an hour's consultation with a respected family lawyer in your area. Lay out the facts, including the unvarnished truth about your income and expenses and your Ex's income and expenses and ask what chances you would have if you ask for a rehearing. I bet you'll be glad you spent the money.
