I am currently living in N.Y. and we still own our house here,he left in Nov. and moved to Me. I plan on moving back to Me. with my family in June, am I better off to file there or here? If I file here,Im afraid it will drag out and I wont be able to move back in June. Can we both get our lawyers in Me. even though the house wont be yet sold?

You can definately both get attorneys in Maine and file there...however you will have to satisfy Maine's requirements for residency first at a minimum....there could be some other requirements you would have to satisfy....best to try and do some Internet research on Maine's requirements, or even consult an attorney there.
As to which is best for you..without knowing more details and the requirements for filing in either state, hard to say.

Talk to your attorney in ME; it's possible that there's no residency waiting period if the defendant now lives in ME. Just remember that if you file now, you may need to travel back and forth to deal with the litigation. You may prefer to wait until you're actually living in ME anyway just for convenience.

Bear in mind that, as a no-fault state - NYS is not the most fun place to get divorced.
