Husband and Wife agree on terms of uncontested divorce. They are ready to sign uncontested documents (including separation agreement) but have not yet signed.

Their youngest daughter will turn 19 in 28 days. Because they must wait 30 days after filing the Complaint for the Judge to enter divorce, must they go thru the child support forms?

Or, could the agreement say "because the youngest child of the parties will turn 19 before the Divorce decree is to be entered, no child support will be paid and no withholding order issued" etc?

PS:  Parties DO NOT want to wait 28 days, which would make the whole deal moot.

Thanks.

Different judges have different perspectives on this. If you talk to the attorney preparing the documents, I bet he or she will be able to suggest an approach that will allow you to avoid dealing with child support.
