Is it possible for me to keep our home and home equity after the divorce (Georgia residence)? Both our names is on the deed. Also, he lives with his mother, don't have a car but has a job. Would I have to split monies that I have saved (checking, money market, CD)? All accounts have only my name on them.  Thanks in advance for responding- Best, Dee

You can keep the house.  Provided you pay him for his share of the equity in the house and refinance the mortgage into your name only.

And ALL money that was acquired, invested, saved, etc. is considered marital assets, including any 401K's.

Doesn't matter where he is living.  He is entitled to his share of the assets.
