In negotiating our divorce, I told my ex that if he would pay whatever my insurance didn't cover for needed surgery & therapy, I would not mention to the judge that he caused the injury.  Guess what!  He doesn't even remember the conversation.  My attorney told me I had six years in Alabama to file a tort, and it's been about five.  This iinjury was accidental; those that were intentional did not require medical treatment.  Should I sue, or do I not have a leg to stand on?

I honestly don't know. If you file, expect an argument from your Ex that the divorce was the appropriate forum for any grievance of this nature, that you didn't assert it then, and that therefore you are estopped from asserting it now in a new forum.
