750 - Would an Uncontested Divorce Work for Us?If you're planning to use a lawyer to help you get divorced, and if you're trying to keep the cost of your divorce as low as possible, an uncontested divorce may work for you even if you and your spouse don't yet agree on all the key issues of your divorce. In an uncontested divorce, only one of you is represented by a lawyer. You work out the issues of your divorce and sign an agreement to resolve them. You don’t go to court, and you don’t depend on the judge to settle any of the issues between you. Uncontested divorce is by far the most common way people get divorced in Alabama, and if you're using a lawyer, it's also the least expensive. A lawyer can represent you or your spouse in a divorce, but he or she cannot represent both of you. That means that I would represent one of you and not the other. I've designed a brief test to help you decide if you and your spouse would be likely to use an uncontested divorce. You can find it on Divorceinfo.com. It's designed for either spouse to be able to do it alone. It takes about five minutes to measure the level of conflict between the two of you, the level of trust between you, and the level of savvy you each have about money. Uncontested divorce can happen faster than most people realize. If you come to my office prepared with all the key information for your divorce, and if you and your spouse really are able to agree on the key issues, I will produce the necessary paperwork while you and I are together, you can sign everything in my office, and you can take the papers to your spouse to sign. Under most circumstances, neither of you would need to go to court. Your divorce would normally be effective within about six weeks after you and your spouse sign the papers.
