Why Does It Take So Long To Confirm Filing?Court staff in Talladega County run 3-4 weeks behind on average. If you're wondering why, take that up with your legislature, which has consistently refused to appropriate the money to provide proper staffing for the Alabama court system. And if you take it up with your legislature, you'll probably hear "take that up with your fellow citizens," who have consistently refused to approve a reasonable property tax system and have insisted instead on making Alabama safe and cheap for large, polluting paper companies. But I digress. Because the court is running several weeks behind, your documents will be stamped as filed on the day they arrive but won't be "worked" for 3-4 weeks. That means I won't hear that they've been filed or that they have a case number for a month or so, and neither will you. However, when the staff do work the case, they'll assign it the filing date on which it arrives, not the date on which they actually enter it into the system. What does all this mean? It means an extra couple of weeks for you and for me, during which we don't have confirmation that your case is filed. Ultimately, however, it doesn't have any impact on your divorce case, because the mandatory 30-day waiting period runs from the date the papers arrive at the courthouse, not the date the clerk enters the information from them. |
